WHAT IS AN ENERGY CERTIFICATE?

It is the certificate essential for selling or renting a property. The energy certificate informs about the energy consumption and CO2 emissions of a property that is advertised for sale or rent.

SINCE WHEN IS IT MANDATORY? The energy certificate is mandatory in Catalonia from 1st of June 2013 to be able to rent or sell an existing property or premises and for buildings or parts of buildings that a public authority occupies more than 250 m2 and are usually frequented by the public.

In 2007, Directive 2002/91 / EC had already been transposed, with Royal Decree 47/2007, which approved the procedure for the energy efficiency certification of new buildings. The obligation to show the energy certificate is regulated in Spain by Royal Decree 235/2013. The energy certification regulations come from a European Directive that has already been complied with by all member states. The responsibility for obtaining this energy certificate lies with the homeowner, who must hire the service of a certifying technician to obtain their energy certificate.

WHAT IS AN ENERGY CERTIFICATE?

The content of the energy certificate is summarized in the energy label. This label, similar in appearance to the energy label present in household appliances, indicates the emissions and consumption ratings that the property has obtained in its energy certificate, on a color scale ranging from A, the more efficient, in the G, the least efficient.

The energy rating indicated on the energy certificate must appear on any advertisement or publicity item on the property.

The owner must provide their energy certificate to theirs real estate agency i include it in your ad on real estate portals.

In case of sale of a property the owner must deliver the energy certificate to the buyer. In addition, the energy certificate must be included in the contract of sale. In case of rent a copy of the energy certificate must be shown and delivered to the tenant. The energy certificate will also be requested when depositing the deposit of a rent with the corresponding official body.

The energy certificate is a report which consists of several pages. It contains abundant information on the orientation, location, surroundings, lighting and energy production systems of the building.

The first page of the energy certificate contains the general data of the property, in addition to the data of the certifying technician. At the bottom is the overall energy rating of the property, in terms of emissions of carbon dioxide released into the atmosphere. It is expressed on a scale from A to G.

This rating will appear on the energy efficiency label, when the energy certificate is registered. The energy consumption rating (Kw h / m2 . year) indicated in Annex II of this report will also appear on the energy label.

In addition to this first page, the report has four annexes where it breaks down the information:

Annex I, describes the thermal characteristics of the property.

Annex II, breaks down the energy rating of the property in the rating of the different energy demands and consumptions.

Annex III, regarding improvement recommendations.

Annex IV, the technician describes the tests, verifications and inspections carried out during the data collection process.

PENALTIES FOR RENTING OR SELLING WITHOUT ENERGY CERTIFICATE

Selling or renting without an energy certificate is an infraction and is punishable by fines ranging from € 300 to € 600.

Law 8/2013, of 26 June, establishes the sanctions for non-compliance with energy certification regulations.

These sanctions are divided into three groups according to the seriousness of the offense. From not mentioning the energy rating obtained in the ads of the property for sale or rent, to sell without having previously made the energy certificate or falsify the result.

Minor infractions will be fined in amounts between € 300 and € 600.

Serious infractions carry associated fines of € 601 to € 1.000.

Very serious infractions carry fines of € 1.001 to € 6.000.

WHO CARRIES OUT THE ENERGY CERTIFICATION?

To obtain the energy efficiency certificate you need the work of one qualified certifying technician. A qualified certifying technician is one who has the qualifying qualification for energy certification. According to RD 235/2013, the qualifications that qualify for energy certification are those of architect, technical architect, engineer and technical engineer. STEPS TO OBTAIN THE ENERGY CERTIFICATE To obtain the energy certificate, the certifying technician must carry out one visit to the property. Once there, it carries out a measurement and collects the construction and installation data (heating, hot water and air conditioning) needed to draw up the energy efficiency certificate. The certifying technician enters the data collected during the visit to the computer program authorized by the Ministry of Industry to obtain the energy certificate. It is mandatory to present the energy certificate to the register ability of each autonomous community. This procedure can be carried out by the certifying technician as the owner’s representative. The enabled registry of each autonomous community issues the energy label of each energy certificate. This notice expresses the energy rating obtained by the property on a scale from A to G.
