The Mortgage Law and the revised text of the Real Estate Cadastre Act, following its reform by Law 13/2015, of 24 June, establish a system of coordination between the Real Estate Cadastre and the Property Registry, so that it incorporates the georeferenced graphic description of the registered estates, using as a basis the cadastral cartography. The aim is to give more security to the location, delimitation and surface data of the registered estates that are the subject of legal traffic.
The graphic validation report (GML) is the result of the service of validation of alternative georeferenced graphic bases, which allows to know if an alternative graphic representation already elaborated, different from the cadastral, meets the technical requirements mentioned above, and in particular the compatibility with the representation of the plots that appear in the cadastral cartography. The graphic validation report in no case validates that the legal operations that give rise to the new configuration of the plots comply with current legislation or have the necessary authorizations from the corresponding administration or public authority.
The validation report is the ideal medium to include alternative graphical representation in a script. The graphic validation report is an electronic document signed by the General Directorate of Cadastre using a secure verification code. The validation report avoids the physical exchange of computer files, allows to visualize the new representation and enables the automated capture of his content preventing possible errors of transcription.
If the validation report is positive, it will contain the cadastral graphical representation that would result from the cadastral alteration of the plots, a list of coordinates of their vertices, and the surface obtained. It will also include the data of the report signed by a competent technician, when he had intervened.
If the notaries or registrars include in the deed or register the alternative graphic representation previously validated by the Cadastre, they may incorporate the secure verification code of the positive validation report for the sending of the graphic data to the Cadastre, which they will serve so that this one realizes the update or rectification that corresponds.
When the validation result is negative, the report will express the errors or defects noticed and the affected cadastral plots not included in the submitted graphic representation.
There are two types of graphical validation reports:
. Of parcel: Graphic validation in front of a cadastral parcel (IVG)
. Of constructions: Cadastral report of location of the constructions (ICUC)
